1. General Policy and Merchant of Record
Quantum Data Technologies Ltd. (“QDT”) partners with Paddle as our Merchant of Record (“MoR”) to manage global payments, tax compliance, and financial liability. As the legal seller of the software, Paddle handles all return and refund requests in accordance with their Buyer Terms and Conditions. By completing a purchase, you acknowledge that you have had the opportunity to review the platform's features, technical specifications, and documentation. The service is provided "as-is," and fees are generally non-refundable except where mandated by law or at the sole discretion of Paddle and QDT.
2. Global Statutory Compliance and Waiver of Rights
Acknowledgement of Local Laws: QDT acknowledges that certain jurisdictions provide consumers with statutory rights to a refund or a "cooling-off" period following a purchase. QDT and its Merchant of Record, Paddle, will honor such mandatory legal requirements where they are applicable and cannot be waived by contract.
Commencement of Performance via Usage: For all digital subscriptions and licenses, you explicitly agree that the delivery of the service and the performance of the contract commence immediately upon your first active utilization of the platform’s core computational resources.
Consumption Trigger: By initiating a model build, executing a simulation, or accessing proprietary data sets within the Quantum ML platform, you are requesting immediate performance of the service. You acknowledge and agree that once any such action is taken, the digital content and associated computational infrastructure are deemed "consumed," and any statutory right to a "change of mind" or "no-reason" refund is waived to the fullest extent permitted by law.
Material Failure to Deliver: In accordance with regional consumer protection standards, if a core feature or specific data set explicitly described as "available" at the time of purchase is permanently discontinued without a reasonable alternative being provided, you may be eligible for a pro-rated refund or service credit at the sole discretion of QDT and Paddle.
3. Subscription and License Terms
Monthly Subscriptions: You may cancel your subscription at any time via the platform dashboard. Access will continue until the end of the current 30-day billing cycle. QDT does not provide pro-rated refunds or credits for unused days within a cycle once the service has been accessed.
Annual Subscriptions & Licenses: Written notice of non-renewal must be provided at least thirty (30) days prior to the end of the current term. If a subscription or license is cancelled mid-term, no refund will be issued for the remaining balance; however, access will remain active until the term expires.
On-Premise Licenses: Fees for On-Premise (In-Tenant) licenses are deemed earned and non-refundable once the software package or license key has been provisioned to the Customer.
4. Self-Serve Platform and Fulfillment
Quantum ML is a standardized, fully automated, self-serve computational platform. Standard retail subscription tiers do not include human-driven services such as manual onboarding, individual training, or bespoke data science consulting. Support is limited to technical troubleshooting of the software itself. All setup and model configurations are the responsibility of the user.
5. Performance and Accuracy Disclaimer
Quantum ML is a technological tool and does not constitute financial, investment, or procurement advice.
Probabilistic Results: Quantitative forecasting is probabilistic and subject to "Model Drift". Discrepancies between a forecast and actual market outcomes do not constitute a "defect" in service or a failure to "deliver as described".
No Outcomes Guarantee: QDT and Paddle are not responsible for, and will not issue refunds for, any financial or operational losses resulting from the use or interpretation of platform outputs.
6. Service Level Credits (SLA)
In the event of a platform outage exceeding the limits defined in our Service Level Agreement (SLA), QDT may issue Service Credits toward your next billing cycle. Service Credits are not transferable, cannot be converted into cash refunds, and do not apply to On-Premise deployments where uptime is the responsibility of the Customer’s infrastructure.
7. Billing Disputes and Refund Requests
Any disputes regarding an invoice must be submitted in writing within fifteen (15) days of the invoice date. To initiate a formal refund request, please contact Paddle’s customer service team directly. Paddle and QDT reserve the right to issue refunds or credits at their sole discretion on a case-by-case basis to resolve disputes and manage chargeback risks.
